Terms of Service
Please read these terms carefully before using DeviceCare. By using our service you agree to these terms.
Acceptance of Terms
By accessing or using the DeviceCare website and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services. DeviceCare reserves the right to update these terms; continued use after changes constitutes acceptance.
Description of DeviceCare Service
DeviceCare is a device repair protection membership platform in South Africa. We provide:
- Access to a network of verified repair partner shops
- Repair discounts and/or repair assistance according to your plan
- Technical support and repair request management
DeviceCare is not an insurance company and does not provide insurance products. Our service is a membership offering repair support and partner access only.
Membership Rules
Membership pricing is personalised and calculated dynamically based on your specific device model, estimated repair cost, and risk score. Your monthly subscription price is unique to you and is locked in at the time of quote acceptance. DeviceCare reserves the right to adjust pricing multipliers for new quotes.
Membership is subject to your personalised quote, the Pricing & Claims Rules, and the Membership Agreement. You must provide accurate information when registering. One membership is per person; benefits are non-transferable.
Repair Assistance Limitations
Repair assistance is subject to waiting periods, claim cadence rules, coverage caps, and exclusions as set out in our Pricing & Claims Rules and Membership Agreement. Eligible claims may receive instant platform approval and are still subject to fraud and quality controls. Repairs must be performed by DeviceCare partner shops. DeviceCare does not guarantee repair outcomes and is not liable for the quality of repairs performed by partners.
User Responsibilities
You agree to:
- Use the service lawfully and only for its intended purpose
- Provide true and complete information
- Not misuse, abuse, or attempt to defraud the service
- Keep your login credentials secure
Partner Repair Invoices & Payouts
Where DeviceCare facilitates payment of approved repair invoices submitted by verified partner shops, DeviceCare will process and pay approved repair invoices within 3 business days of approval, subject to successful fraud checks, correct banking details, and public holidays in South Africa. This does not change the fact that DeviceCare is not an insurance provider; it describes operational timing for an approved programme payment only.
Membership rules, claim eligibility (including minimum contribution periods and spacing between claims), payment obligations, and subscription terms continue to apply as described in our Membership Agreement, Pricing & Claims Rules, and the sections below.
Subscription Billing via PayFast
DeviceCare is a subscription-based membership service. Subscription fees are personalised and billed monthly through our payment provider, PayFast. Your monthly amount is determined by your personalised quote and is unique to your device. By subscribing you authorise recurring charges of your quoted amount until you cancel. Prices are in South African Rand (ZAR). Total contributions accumulate and directly affect your claim co-pay calculation. See our Refund Policy for billing disputes.
Benefits are only available to ACTIVE paying members whose accounts are in good standing and who satisfy verification and programme rules. If a recurring payment fails, your account may enter a grace period of up to fourteen (14) days during which certain benefits (including new repair claims) may be restricted or suspended as described in your dashboard and the Membership Agreement.
If payment is not successfully completed within the grace period, DeviceCare may revoke your membership, treat your subscription as cancelled, and you will lose all programme benefits and eligibility to submit new repair claims, without turning DeviceCare into an insurance product — we remain a membership and repair-assistance platform only.
DeviceCare is not an insurance provider and does not sell insurance policies. Billing status, grace periods, and revocation do not create an insured risk transfer; they govern access to the membership programme only.
Cancellation Policy
You may cancel your membership at any time. Cancellation takes effect at the end of the current billing period. No refund is due for the remainder of the period unless otherwise stated in our Refund Policy. DeviceCare may suspend or terminate accounts for breach of these terms.
Liability Limitation
To the fullest extent permitted by South African law, DeviceCare and its partners shall not be liable for indirect, consequential, or punitive damages, or for loss of data or profit. Our total liability is limited to the fees you paid in the twelve months preceding the claim. Nothing in these terms excludes liability that cannot be excluded by law.
Account Suspension for Abuse
DeviceCare may suspend or terminate your account if we reasonably believe you have abused the service, submitted false claims, or breached these terms. We may also suspend accounts for non-payment. You remain liable for any amounts due up to the date of termination.
Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts. If any provision is found unenforceable, the remainder of the terms remains in effect.
